Montana Democratic Party Statement on Major Voting Rights Victory
 
Helena, MT – Yellowstone County District Court Judge Donald Harris yesterday ruled in the Montana Democratic Party’s favor in the case of Driscoll v. Stapleton. The decision rules BIPA unconstitutional, and provides that all ballots postmarked before or on election day and received by the following Monday will be counted in this election.

“This ruling represents a major victory in making sure all Montanans have access to the ballot,” said MDP Chair and lawsuit plaintiff Robyn Driscoll. “This will provide an additional safeguard for Montana voters to ensure that their votes are counted. But to be on the safe side, we encourage all Montanans to get their ballots turned in as soon as possible after they receive them.

“The right to vote is a fundamental building block of our democracy, and the Montana Democratic Party will always fight to ensure that every Montanan has the opportunity to make their voice heard on Election Day — period.”
